This notice serves to reiterate and elaborate on the firm's strict policy on upholding high standards of professional conduct and compliance with relevant laws and regulations.
We have a no tolerance policy towards conduct by any of its partners, lawyers, employees and staff which constitutes non-compliance with the Malaysian Anti-Corruption Act 2009, including:
(a) soliciting, receiving or agreeing to receive, accepting or obtaining or giving, promising or offering gratification as an inducement to or a reward for any person doing or forbearing to do anything or to show favour or disfavour or to obtain or retain business or an advantage in the conduct of business;
(b) giving to an agent or using with intent to deceive, any receipt, account or other document which contains any false statement which is intended to mislead a principal;
(c) using office or position for gratification (abuse of position); and
(d) failing to report when offered gratification/bribery.
Further, all employees are reminded of the following Bar Council ruling:
“14.23. Payment for introducing clients
The acceptance by an Advocate and Solicitor (“Introducer”) of any form of payment (such as commission) from any person merely for introducing clients to such person without the provision of legal services by the Introducer, is tantamount to touting on the part of the Introducer. Likewise, an Advocate and Solicitor shall not make any form of payment to any person for introducing clients to such Advocate and Solicitor.
Provided that this Ruling shall not prohibit the sharing of fees and costs by an Advocate and Solicitor with a qualified person, for legal services rendered by the Advocate and Solicitor.”
As a firm, we are committed not to directly or indirectly engage in bribery or corruption in any form.
We also expect that all third parties engaged by us or performing work or services on behalf of us will comply with the same anti-bribery and anti-corruption principles.
The firm is also committed to compliance with standards and guidance issued by Bank Negara Malaysia (Central Bank Malaysia).
Enforcement:
Non-compliance with this policy will result in disciplinary action in accordance with the firm's regulations and professional standards. We are committed to upholding the highest ethical standards and expect all members to adhere strictly to this policy.
